TrakBak Terms of Use

Last updated: September 2026

1. About TrakBak

TrakBak is operated by TRAKBAK LTD, a company registered in England and Wales under company number 17403636, with its registered office at 9 Down End Road, Fareham, Hampshire, United Kingdom, PO16 8RG.

TrakBak is a creative community and platform designed to help songwriters, musicians and other creators develop their work, collaborate, exchange FeedBak, share music and discover other creators.

These Terms of Use govern your access to and use of TrakBak.

By creating an account or using TrakBak, you agree to these Terms and agree to comply with our Community Guidelines.

2. Who can use TrakBak

You must be at least 16 years old to create a TrakBak account.

By creating an account, you confirm that you are 16 or over and that the information you provide is accurate.

You are responsible for keeping your account credentials secure and for activity carried out through your account.

Accounts are personal and must not be transferred or shared with another person without our permission.

3. TrakBak services

TrakBak may provide features including Studio workspaces, audio, video and lyric tools, Creator Profiles, collaboration, FeedBak, community features, Discovery, Charts, competitions, awards, learning resources and creative-assistance tools.

Features may change as TrakBak develops.

4. Your creative work remains yours

You retain ownership of the original music, lyrics, recordings, videos, artwork and other creative material you create and upload to TrakBak.

Uploading something to TrakBak does not transfer ownership of that work to TRAKBAK LTD.

You are responsible for ensuring you have the necessary rights and permissions for material you upload, publish or otherwise make available through TrakBak.

5. Permission you give TrakBak

To operate TrakBak, we need limited permission to process material you upload.

When you upload content, you grant TRAKBAK LTD a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, technically adapt and display that content only as reasonably necessary to provide the TrakBak services and features you choose to use; make content available to collaborators or FeedBak participants you select; display content through public or community features where you choose to make it available; provide playback, streaming, transcoding, formatting, thumbnails and similar technical functionality; and maintain backups, security and platform integrity.

This licence does not transfer ownership of your work to TrakBak.

Our ability to display your work publicly depends upon the publishing and visibility choices you make.

Except where continued retention is reasonably necessary for legal, security, backup or collaborative-record purposes, this licence ends when the relevant content is deleted from TrakBak.

6. Collaboration does not mean surrendering your rights

Collaboration is fundamental to TrakBak, but collaborating with somebody does not automatically give either person unrestricted rights to the other's contribution.

If a track, recording, lyric, video or other work contains material owned or controlled by somebody else, you must have the necessary rights or permissions before publishing or sharing that material beyond the authorised collaboration.

Where a collaborative work is jointly owned, you must not publish or make that work publicly available through TrakBak unless you have the necessary permission from the relevant rights holder or rights holders.

This remains the case even if you made a substantial contribution to the work; you are credited as a songwriter, musician, producer or collaborator; you possess a copy of the recording or files; the material was previously shared privately; the collaboration has ended; or the people involved have fallen out or stopped communicating.

Uploading material to a private TrakBak collaboration does not automatically give another collaborator permission to publish it publicly.

TrakBak does not determine songwriting percentages, copyright ownership, master ownership, royalties or other financial arrangements between collaborators. Creators are responsible for agreeing those matters between themselves.

7. FeedBak

FeedBak exists to help creators develop their work.

Providing ordinary suggestions, opinions and creative feedback through FeedBak does not automatically make the person providing that FeedBak a songwriter, co-author, collaborator or rights holder in the work.

Unless separately agreed between the people involved, a person providing FeedBak gives the recipient permission to consider, experiment with and incorporate ordinary suggestions made through FeedBak without payment or attribution.

Creators remain free to accept, reject or experiment with FeedBak.

Creator responses such as Love This, Worth Exploring, Made a Change and Keeping As Is indicate how a creator responded to FeedBak. They do not themselves establish intellectual-property ownership or contractual rights.

Nothing in this section is intended to override rights that arise under applicable copyright law from a genuine copyright-protected contribution.

8. Community Guidelines

Everyone using TrakBak must comply with our Community Guidelines.

Those Guidelines apply across TrakBak, including Creator Profiles, tracks, lyrics, audio, video, artwork, FeedBak, replies, collaborations, invitations and community features.

Among other things, they prohibit harassment, stalking, threats, abusive behaviour, unwanted contact, hate and discrimination, sexual harassment, privacy violations, impersonation and attempts to circumvent blocks.

Serious or repeated breaches may result in content removal, restrictions, suspension or termination.

9. Music must not be used to target another person

TrakBak recognises that songwriting frequently draws on real experiences, relationships and emotions.

A song is not prohibited simply because a real person inspired it.

However, you must not use songs, lyrics, recordings, videos, artwork, titles, descriptions or other creative content to harass, threaten, intimidate, humiliate, expose or deliberately target an identifiable person.

This applies even if the person is not named.

A person may be identifiable from circumstances, relationship details, private events, locations, images, messages, recordings, nicknames or a combination of other information.

A pattern of repeatedly publishing material targeting the same person may breach these Terms and our Community Guidelines even where an individual item viewed alone might not.

These protections apply whether or not the person being targeted has a TrakBak account.

10. Harassment, stalking and unwanted contact

You must not use TrakBak to stalk, harass, intimidate or repeatedly target another person.

You must not repeatedly contact somebody who has made it clear that contact is unwanted.

You must not circumvent a block by creating another account, using another person's account, using another TrakBak feature or asking somebody else to make contact on your behalf.

You must not use information obtained through TrakBak to locate, track, intimidate or continue unwanted contact with somebody elsewhere.

A pattern of behaviour may breach these Terms even if individual interactions viewed separately do not appear abusive.

11. Privacy and private material

You must respect other people's privacy.

You must not improperly disclose another person's private or identifying information, private communications, recordings, photographs or other private material.

You must not publish or threaten to publish such information to expose, humiliate, intimidate, threaten or harass somebody.

12. Human creativity and AI

TrakBak exists to support and celebrate human creativity.

You must not knowingly present substantially AI-generated music, lyrics, vocals, performances or other creative work as human-created original work where doing so breaches TrakBak's published AI/content rules.

TrakBak may provide AI-assisted educational or Creative Companion functionality intended to help creators learn, explore or develop their skills.

Use of approved TrakBak Creative Companion functionality does not itself make a work prohibited AI-generated content.

More detailed AI/content rules may be introduced as the platform develops.

13. Copyright and rights complaints

Only upload material you have the right to use.

If somebody believes content on TrakBak uses their music, recording, lyrics or other protected material without permission, they may report it to us.

This includes a collaborator or other relevant rights holder who believes collaborative material has been published without the necessary permission.

We may temporarily restrict disputed material while a legitimate rights complaint is investigated.

We may request information from the uploader and claimant to help us understand the rights involved.

A report does not automatically establish infringement, and TrakBak is not a court or copyright tribunal.

Repeated or serious infringement may result in account restrictions or termination.

14. Blocking and reporting

Where TrakBak provides blocking functionality, users must respect another person's decision to block them.

Attempting to circumvent a block may itself constitute a breach of these Terms.

Users may report content or behaviour they reasonably believe breaches these Terms or our Community Guidelines.

Making a report does not guarantee that content will be removed.

We may consider the content, context, available evidence, previous behaviour and any apparent pattern when reviewing a report.

Deliberately false or malicious use of reporting systems may itself result in action.

15. Moderation and enforcement

Depending on the nature and seriousness of an issue, TrakBak may remove or restrict content; issue warnings; restrict access to particular features; restrict interaction between accounts; temporarily suspend an account; or permanently terminate an account.

Serious safety, harassment, rights or security matters may result in immediate action.

Where appropriate, we may provide a mechanism for users to challenge a moderation decision.

Where we reasonably believe there is a credible and immediate risk to someone's safety, or where required by law, we may preserve relevant records and cooperate with appropriate authorities in accordance with applicable law.

16. Creator Profiles and public content

You control what you choose to publish through your Creator Profile and other public features, subject to the functionality available.

Making material public through TrakBak does not transfer ownership of that material to other users or grant them permission to commercially exploit it.

17. Discovery and Charts

TrakBak may use platform activity and other relevant signals to surface works and creators through Discovery, Charts, recommendations and similar features.

Appearance or position in these features is not guaranteed.

Users must not artificially manipulate plays, FeedBak, engagement, votes or other signals used by these systems.

18. Competitions and awards

TrakBak may offer competitions, awards and other recognition programmes.

Specific competitions may have additional rules covering eligibility, entry periods, judging, prizes and other conditions.

Those rules will apply in addition to these Terms.

Unless the relevant competition rules expressly state otherwise, entering a competition does not transfer ownership of your work to TrakBak.

19. Paid services

TrakBak may introduce paid subscriptions, credits or other paid services.

Where applicable, pricing, billing periods and significant conditions will be presented before purchase.

We will not charge you for a paid service without your agreement.

Additional subscription, cancellation and refund terms will be provided where required.

20. Account closure

You may close your account using the functionality available or by contacting us where necessary.

Content solely associated with your account will normally be deleted or anonymised in accordance with our Privacy Policy and applicable retention requirements.

Certain records may need to remain where they form part of a collaboration, FeedBak received by another creator, interactions involving other users, security records, legal obligations or disputes.

Closing a TrakBak account does not cancel rights or agreements independently established between collaborators or other parties.

21. Availability and changes to TrakBak

We aim to provide a reliable service but cannot guarantee uninterrupted or error-free availability.

We may improve, modify, replace or discontinue features as TrakBak develops.

Where a change materially affects a paid service, we will take reasonable steps to communicate it where appropriate.

22. Third-party services

Some TrakBak functionality may depend upon third-party services.

Those providers may have their own terms and privacy policies where you interact directly with them.

We are not responsible for third-party services outside our reasonable control.

23. Our responsibility to you

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

TrakBak provides creative and community tools. We do not guarantee that using TrakBak will result in commercial success, publication, collaboration opportunities, chart performance, awards, recording contracts or other professional outcomes.

We are not responsible for agreements made independently between users concerning matters such as copyright ownership, songwriting shares, royalties or commercial exploitation.

24. Consumer rights

If you use TrakBak as a consumer, you may have statutory rights under UK consumer law.

Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded.

Additional provisions concerning cancellation, subscriptions and digital services will be provided where required when relevant paid services are introduced.

25. Privacy

Our Privacy Policy explains how TRAKBAK LTD collects and uses personal information.

26. Changes to these Terms

We may update these Terms as TrakBak develops or where legal or regulatory requirements change.

Where changes are material, we will take reasonable steps to bring them to users' attention.

The date at the beginning of these Terms shows when they were most recently updated.

27. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may also have mandatory rights under the laws applicable where you live.

Nothing in these Terms removes any right you have to bring proceedings in a court available to you under applicable consumer law.
